Shelby Band Director Accused Of Rape By His Girlfriend

ONTARIO, OH - Shelby High School's Band Director's girlfriend has accused him of rape.

27-year-old Oyun Benjamin Hyun's girlfriend claims the alleged incident took place at his home on Scott Drive in Ontario.

The preliminary hearing was scheduled for Thursday at Mansfield Municipal Court, however, this case will now be bound over to a Richland County grand jury after Hyun waived his rights to a preliminary hearing. 

On, November 21st, the Ontario Police Department received a call from OhioHealth Mansfield Hospital for a reported rape that occurred in their jurisdiction.

Officers obtained an arrest warrant for Hyun for a charge of rape, a first-degree felony, and Hyun was then arrested on November 27th and booked into the Richland County Jail. 

Hyun was released on the following day, November 28th, after posting a $75,000 bond following his arraignment in Mansfield Municipal Court. 

A written statement from the victim was provided to the Ontario Police Department on November 21st explaining how the assault occurred. 

According to the report, 'she was at her boyfriend's condo in Ontario' when he tried to take her pants off and put his hands on her genital area. 

Hyun attempts to put his hand down her pants multiple times before he forced himself on her and proceeded to rape her, according to court records. 

"After he tries several times to have sex with her, she is able to get him off of her and grabs her belongings and runs out the door. The boyfriend holds the door closed and starts to apologize to her. He then tells her to kill him as he deserves it." 

Hyun later voluntarily went to the Shelby Police Department once contacted and confirmed the statement was true. 

The Statement of Facts from the Richland County Prosecutor's Office read: "When asked if she asked him to stop or said no, Oyun stated she did. When asked how many times, Oyun stated "too many times." 

The Ontario Police Department has stated that the case has no affiliation with Shelby City Schools or any of its students or any other employees. 

A School Resource Officer with Shelby City Schools assisted the Ontario Police Department in locating Hyun. 

The following statement was released by the Shelby City School District on November 27th: 

"A Shelby City School teacher has been suspended as require by O.R.C. Section 3319.40, pending the investigation of a criminal charge by the Ontario Police Department.

Specifics regarding the allegations against Mr. Hyun, should be directed to the Ontario Police Department. It is the District's understanding that the investigation involves a report of conduct that occurred off school grounds and off school time. Furthermore, the alleged incident and criminal charge(s) does not involve any current Shelby City School District student or resident of the city of Shelby."

Hyun is scheduled to appear in Richland County Court Of Common Pleas on March 27th, 2018 for arraignment at 1:00 p.m.
